Our Roles: Controller and Processor

Mapsly processes personal information in two distinct roles. When our customers and their end users upload, import, synchronize, or generate data within the Service — such as CRM records, contact information of a customer’s own customers and prospects, and end-user location data collected at the customer’s direction — Mapsly processes that data as a processor (service provider) on the customer’s behalf, under the customer’s instructions and the Mapsly Data Processing Addendum available at https://mapsly.com/dpa (the “DPA”). The customer, not Mapsly, determines the purposes of that processing. If your personal information is contained in such data, please direct privacy inquiries and rights requests to the relevant Mapsly customer (for example, your employer or the business you interacted with); we will support that customer in responding as described in the DPA.

Mapsly acts as a controller of the personal information described in this Privacy Policy — such as account, authentication, billing, usage, support, website-visitor, and marketing information — and this Privacy Policy governs that processing.

Data that you or your organization upload, import, synchronize, or generate within the Service — including your organization’s CRM records and End-User location data collected at your organization’s direction — is Customer Data processed on your organization’s behalf under the DPA, as described in “Our Roles: Controller and Processor” above. The lists below describe controller-side collection; where an activity or data type occurs through a customer’s use of the Service and at the customer’s direction, the resulting information is Customer Data governed by the DPA rather than this section.

(*) NOTE: when you provide us with your payment information, including credit card data, you enter this information directly into the software of our PCI DSS-certified payment provider embedded into Mapsly Offerings — therefore, Mapsly itself does not receive, store, or process this information on its servers.

AI features. Certain Mapsly Offerings use artificial intelligence technologies — for example, to transcribe and summarize audio, or to generate suggestions and content. Content processed by AI features is handled by AI service providers acting on our behalf solely to provide the relevant functionality. We do not use your content, or our customers’ data, to train generalized artificial intelligence or machine learning models.

Legal Bases for Processing (EEA, UK, and Switzerland)

Where the GDPR, the UK GDPR, or Swiss data protection law applies to personal information for which Mapsly is the controller, we rely on the following legal bases: performance of a contract, when we process your information to provide Mapsly Offerings you or your organization have subscribed to; our legitimate interests, when we process your information to operate, secure, support, and improve Mapsly Offerings, to prevent abuse, and to communicate with business users about our services, balanced against your interests and rights; your consent, where required by applicable law (for example, for certain cookies or marketing communications), which you may withdraw at any time; and compliance with legal obligations, when processing is necessary to comply with applicable law.

Examples include: sending communications, processing payments, analyzing data, providing marketing and sales assistance (including advertising), and conducting customer relationship management. Further, they must process that information in accordance with this Privacy Policy and as permitted by applicable data protection law.

Mapsly LLC is located in the United States, and data processed by the Service is stored in the United States. Depending on the scope of your interactions with Mapsly Offerings, your personal information may be accessed from other countries in which our personnel and service providers operate, solely to provide, maintain, and support Mapsly Offerings. Whenever we transfer personal information across borders, we do so in accordance with this Privacy Policy and applicable data protection laws — including, for transfers from the European Economic Area, the United Kingdom, and Switzerland, the Data Privacy Framework described below and, where applicable, the EU Standard Contractual Clauses incorporated into our DPA.

  • 账户信息: If you want to add, update, or delete information related to your account, please go to the Mapsly Setup Console. When you update or delete any information, we usually keep a copy of the prior version for our records for integrity, security, and audit purposes; prior versions are deleted when your account is removed or in accordance with our retention practices.
  • Account Removal: An authorized administrator of your organization may request removal of the organization’s Mapsly account, and you may request deletion of personal information that Mapsly processes as a controller about you, at any time by contacting our support via email or chat. Requests concerning Customer Data processed on behalf of your organization should be directed to your organization, as described in “Our Roles: Controller and Processor” above. We may retain certain information where required for legal, security, billing, fraud-prevention, or audit purposes, consistent with the “Retention of personal information” section.
  • 通讯: If you do not want to receive promotional messages from us, please unsubscribe from our emails by clicking “unsubscribe” in our emails or by contacting our support by chat or email. If you do not want to receive in-app notifications from us, please adjust your notification settings in the app or your device.
  • Cookies偏好设置: You can change your cookie preferences on the Mapsly website at any time by clicking Cookie Preferences in the footer of the Mapsly site. You can also manage cookies through your browser settings. The “Help” feature on most browsers and devices will tell you how to remove cookies from your device, how to prevent your browser or device from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.

  • Geolocation data: You may prevent the collection of your location data by deactivating Location tracking in User preferences in the Mapsly mobile app on your mobile device or by revoking the system permission to track location for the Mapsly mobile app in your device’s settings.

Mapsly Offerings are business services intended for use in a trade or business and are not directed to children. We do not provide Mapsly Offerings for purchase by children and do not knowingly collect personal information from children under 16. If you believe that a child has provided us with personal information, please contact us and we will delete it.

We keep your personal information to enable your continued use of Mapsly Offerings for as long as it is required in order to fulfill the relevant purposes described in this Privacy Policy, as may be required by law (including for tax and accounting purposes), or as otherwise communicated to you. How long we retain specific personal information varies depending on the purpose for its use, and we will delete your personal information in accordance with applicable law. Following termination of a customer’s agreement, customer data processed under the DPA is deleted as described in the DPA — from active systems no later than ninety (90) days after termination, subject to legal retention requirements and backup rotation cycles.

Your Rights (EEA, UK, and Switzerland)

If the GDPR, the UK GDPR, or Swiss data protection law applies to you, you have rights with respect to personal information for which Mapsly is the controller, subject to the conditions of applicable law: the right to request access to your personal information and a copy of it in a portable format; the right to request rectification of inaccurate information and erasure of your information; the right to request restriction of, or to object to, certain processing, including processing based on our legitimate interests and processing for direct marketing; the right to withdraw consent at any time where processing is based on consent, without affecting processing before withdrawal; and the right to lodge a complaint with your local supervisory authority, the UK Information Commissioner’s Office, or the Swiss Federal Data Protection and Information Commissioner. To exercise these rights, contact us using the details in the “Contacts, Notices, and Revisions” section below. If your personal information is contained in data that Mapsly processes on behalf of a customer, please direct your request to that customer, as described in “Our Roles: Controller and Processor” above.

EU Representative

Mapsly LLC has designated Mapsly Europe Ltd as its representative in the European Union pursuant to Article 27 of the GDPR. If you are in the European Economic Area, you may contact our EU representative, in addition to or instead of Mapsly LLC, on all issues related to our processing of your personal data:

Our business changes constantly, and our Privacy Policy may also change. You should check our website frequently to see recent changes. You can see the date on which the latest version of this Privacy Policy was posted. We maintain an archive of prior versions of this Privacy Policy. Unless stated otherwise, our current Privacy Policy applies to all personal information we have about you and your account. We will never materially change our policies and practices to make them less protective of personal information collected in the past without informing affected customers and giving them a choice.

This section also serves as a Notice at Collection where required by applicable State Privacy Laws. The availability and scope of particular rights are subject to the definitions, applicability thresholds, exceptions, and exemptions of the relevant law.

Categories of personal information collected. The personal information that we may collect, or may have collected from consumers in the preceding twelve months, fall into the following categories described in applicable State Privacy Laws, depending on how you engage with the Mapsly Offerings:

We collect this information from you, automatically through your interaction with the Mapsly Offerings, or from third parties. For more information about the personal information we collect please refer to the “Personal Information We Collect” section above. We collect this information for the business and commercial purposes described in the “How We Use Personal Information” section above.

Categories of personal information disclosed for a business purpose. The personal information that we may have disclosed about consumers for a business purpose in the preceding twelve months falls into the following categories described in applicable State Privacy Laws, depending on how you engage with the Mapsly Offerings:

Your Data Rights. Depending on the State Privacy Law applicable to you, you may have the right to confirm whether Mapsly processes your personal information; request access, correction, deletion, or a portable copy of it; opt out of the sale of personal information, targeted advertising, or certain profiling or automated decision-making; limit certain uses or disclosures of sensitive personal information; withdraw consent where processing is based on consent; and appeal a denial of your request by submitting a form that will be provided to you if we deny a data request. These rights are subject to applicable exceptions and may not apply to information Mapsly processes solely on behalf of a customer. To exercise these rights, please contact our support by chat or email, or at the address in the “Contacts, Notices, and Revisions” section above. Depending on your data choices, certain services may be limited or unavailable. To ensure the security of your Mapsly account, we will generally ask you to verify your request using the contact information you have already provided. If you are an authorized agent making a request on behalf of a consumer pursuant to applicable state law, we may ask you to provide information verifying you have proper authority to make the request on behalf of the consumer or we may ask the consumer to verify their identity with us directly.

No Sale or Sharing of Personal Information. Mapsly does not sell personal information and does not share personal information for cross-context behavioral advertising, as those terms are defined under applicable State Privacy Laws.

Sensitive Personal Information. Where Mapsly processes sensitive personal information subject to State Privacy Laws (such as precise geolocation), Mapsly uses and discloses it only for purposes permitted without a right to limit or opt out, or otherwise provides the rights required by applicable law. Mapsly does not use sensitive personal information to infer characteristics about individuals.

Retention. We keep your personal information to enable your continued use of Mapsly Services, for as long as it is required in order to fulfill the relevant purposes described in this Privacy Policy, as permitted or as may be required by law, or as otherwise communicated to you.

Non-Discrimination. Mapsly will not discriminate against an individual for exercising a privacy right provided by applicable State Privacy Laws.

De-identified Data. Where Mapsly maintains de-identified data, Mapsly takes reasonable measures to ensure that the data cannot be associated with an individual, publicly commits to maintaining and using the data in de-identified form without attempting to re-identify it except as permitted by applicable law, and requires recipients of the data to comply with applicable restrictions.

Profiling and Automated Decision-Making. We do not engage in profiling of individuals in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under applicable State Privacy Laws.
